Trade Terms and Conditions for uSeat® travel

The uSeat® travel is only sold to trade customers to ensure a safe installation, specifically of the tested seat. The fitting instructions are similar to most tested rock n roll beds and require four bolts through the vehicle floor to secure.

When submitting this application form you (the customer) agree to the Terms and Conditions on the following page.

These Terms and Conditions govern the supply of the uSeat® travel by Coolwhip campers LTD to trade customers only (the customer), specifically limited companies (Ltd.) and sole trading professional companies. By placing an order for Products with the Supplier, you acknowledge that you have read, understood, and agree to be bound by these Terms.

  1. Acceptance of Terms

1.1. These Terms constitute the entire agreement between the Supplier and the Customer regarding the supply of Products. No other terms or conditions, whether implied by trade, custom, practice, or course of dealing, shall apply. 1.2. By proceeding with a purchase, the Customer warrants that they are a trade limited company or a sole trading professional company and possess the necessary expertise, qualifications, and resources to understand and comply with these Terms.

  1. Customer Responsibility for Building, Fitting, and Safety

2.1. Critical Safety Warning and Professional Responsibility: The Customer expressly acknowledges and agrees that the Products are designed for installation into vehicles. The correct and safe installation of these Products is paramount for the safety of vehicle occupants and compliance with all relevant regulations. More information on fitment can be found from FWX direct, the supplier of the frame itself. The Customer accepts full and sole responsibility for the proper building (if supplied as a kit), fitting, installation, and ongoing maintenance of the Products.

2.2. Professional Installation Requirement: The Customer warrants that all installation work will be carried out by competent, qualified, and experienced professionals who possess a thorough understanding of vehicle safety standards, structural integrity, and the specific requirements for fitting vehicle seating.

2.3. Understanding of Safety Importance: The Customer confirms their understanding of the critical importance of safety when fitting the Products. This includes: a. Adherence to Instructions: Strictly following all fitting instructions, manuals, diagrams, and safety guidelines provided by the Supplier. b. Vehicle Compatibility: Ensuring the Product is compatible with the specific vehicle make, model, and year, and that the vehicle structure can safely accommodate the Product and its intended load. c. Structural Integrity: Verifying and, if necessary, reinforcing the vehicle’s structural points where the Product will be mounted, ensuring they are adequate to withstand forces in normal operation and in the event of an impact. d. Fastenings and Torque: Using appropriate, high-quality fastenings (bolts, nuts, washers, etc.) and applying correct torque settings as specified in the installation instructions or relevant vehicle manufacturer guidelines. e. Seatbelt Integration: Ensuring proper integration of seatbelts and their anchor points, if applicable, in accordance with safety standards. f. Post-Installation Checks: Conducting thorough post-installation checks and, where required, obtaining certification or approval from relevant authorities (e.g., vehicle inspection bodies, type approval agencies).

2.4. Liability for Installation: The Customer acknowledges that any failure to build, fit, or maintain the Products correctly, or any deviation from the Supplier’s instructions or applicable safety standards, may result in serious injury, death, or property damage. The Supplier shall not be liable for any loss, damage, injury, or death arising directly or indirectly from the Customer’s or any third party’s incorrect, negligent, or improper building, fitting, installation, use, or maintenance of the Products.

  1. Product Suitability and Use

3.1. The Customer is responsible for ensuring that the Products ordered are suitable for their intended application and comply with all relevant vehicle regulations in the jurisdiction where the vehicle will be used. 3.2. Products are supplied for their intended purpose as vehicle travel seats. Any modification, alteration, or use of the Product for purposes other than its intended design is strictly at the Customer’s own risk and will void any warranty.

  1. Limitation of Liability

4.1. The Supplier’s liability for any breach of these Terms, or for any defect in the Products, shall be limited to the replacement of the defective Product. 4.2. To the maximum extent permitted by law, the Supplier shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: a. The Customer’s or any third party’s building, fitting, installation, use, or inability to use the Products. b. Any unauthorized access to or use of our services or products. c. Any conduct or content of any third party on the services or products. d. Any content obtained from the services or products. e. Unauthorized access, use, or alteration of your transmissions or content.

  1. Indemnification

The Customer agrees to indemnify, defend, and hold harmless the Supplier, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from or relating to: a. The Customer’s breach of these Terms. b. The Customer’s negligent or improper building, fitting, installation, use, or maintenance of the Products. c. Any claims by third parties (including vehicle occupants) arising from the installation or use of the Products by the Customer or any party acting on the Customer’s behalf.

  1. Product Information and Warnings

6.1. The Supplier will provide reasonable product information, specifications, and installation instructions. It is the Customer’s responsibility to review and understand all such documentation prior to installation. 6.2. Any dimensions, weights, or performance figures provided are approximate and for guidance only. The Customer should always verify critical dimensions and specifications before commencing installation.

  1. Governing Law and Jurisdiction

7.1. These Terms shall be governed by and construed in accordance with UK and European law 7.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts.

  1. Entire Agreement

These Terms, together with any order confirmation or invoice, constitute the entire agreement between the Customer and the Supplier and supersede all prior agreements, understandings, and arrangements, whether written or oral, relating to the subject matter hereof.

  1. Fitment

Pre-scribed kits are designed to fit with an overall floor thickness of 15mm, along with traditional two pieces wall ply lining, not large one-piece ply lining. Any variations to your van may cause fitting issues.

Product pictures can differ from current manufacture product due to consistent improvements. We may also use different range within the same vehicle, or different vehicles within the same range to demonstrate the product, please read and understand what product you are purchasing.

We reserve the right to cancel any order.

Due to constantly improving our products, your product may have slight alterations from the online description or picture. 

Before making an order, you are agreeing to these terms and conditions. The furniture needs modifying for any driver over 6ft3 to allow enough space for the seat, please add to customer notes on checkout if necessary.

 

  1. Refunds 

Every furniture kit is bespoke and made to order. As a result, we cannot offer refunds or returns once an order has been placed. Therefore, we ask you to check the order thoroughly before making payment. Colours can appear slightly different in real time than online. It is the responsibility of the customer to request samples from our suppliers Morland before purchasing.

 

  1. Water Damage/ Maintenance

If the edge of any ply takes on water, the laminate can delaminated. Ply edges where in contact with the floor are most as risk. The customer is responsible to seal edges themselves; we recommend watered down water proof PVA, for the birch edges seal with an oil or wax. Solid oak worktops must be sealed with a wax or Osmo oil, if the oak is not sealed it can absorb moisture and bow, we recommend re treating every 12 months. Strictly do not use any flammable agents on the Worktop when fitting a gas grill.   

 

  1. Our liability

We will not be held responsible for any losses incurred due to a delay in delivery. Lead times are accurately calculated however only an estimate. During busy periods, our materials can take longer to arrive from suppliers causing delays in lead times.  

 

  1. Website 

We will not accept liability for any complaints arising as a result of any use of, or the inability to use, any information on this website. Visitors who use this website and rely on any information do so at their own risk. We do not represent or warrant that the information accessible via the website is accurate, complete or up to date.

 

  1. Data privacy and payment

Orders are processed in accordance with UK law and any information taken is not sold or passed on to third parties.

 

  1. Delivery

You the purchaser are responsible for making sure we can deliver to the selected address; that must be accessible for at least a 7t truck vehicle. If you have restricted access you must inform us before purchasing. Two able people are required to offload the goods that will arrive via a pallet, assess the packaging, and sign the delivery document.  

 

  1. Damaged goods

Upon delivery you will be required to examine the goods and check the condition of the packaging for any damage caused in transit, you will sign to confirm you have received the goods in a clear from visible damage condition. If you refuse to sign the delivery document, you will fall under refusal to accept delivery. If the packaging is considerably damage, you must record this on the delivery document and take pictures where possible prior to opening. Any damaged goods may require inspection at a later date. If we do not have the chance to access damaged goods, it could affect any claim for replacement. Failure to do this voids insurance claims against the carriers and we will not be held responsible for damage to goods whilst in transit.

Any further damage found not caused in transit must be reported to our customer service team within 5 working days of delivery. if we can confirm responsibility of the damage, we will rectify and problems free of charge as soon as possible. However, once the goods have been delivered and signed, you become the owner of those goods and from that point they will be at your risk, therefore you will be liable for any subsequent damage. We have the right not replace anything we cannot accept fault for, therefore if you the customer damage any goods, replacements could be chargeable.

  1. Regulations

All products sold are not NCC approved. There are many rules and regulations a camper van must abide by for NCC approval and commercial use. We are unfortunately unable to approve products as the NCC requires the full conversion to be carried out by the same company who have passed the NCC inspection. 

This disclaimer states you understand we are not required to design our products around any manufacturer recommendations, NCC regulations, and or any UK regulations and that you take full responsibility for the conversion of your van. You understand using the vehicle in a commercial setting such as a rental may involve certain regulation requirements  

If you would like your Dometic 9722 grill cut out within the manufacturer’s recommendations, please email and we can remove the overhead top locker, the recommended height clearance is 500mm which is not possible without the removal of the top locker.

We recommend professional advice with regards to safely converting your van, we strongly recommend the basics such as M1 crash tested seating and HAB check certificates.
